These Terms of Service (“Terms”) govern your access to and use of ColorMe, operated by 402labs (“we,” “us,” or “our”). Please read these Terms carefully before using the service. By creating an account or using ColorMe, you agree to be bound by these Terms.
By accessing or using ColorMe, you confirm that you are at least 18 years old (or at least 13 years old with verifiable parental consent), that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree, you may not use ColorMe. If you are accepting these Terms on behalf of an organization, you represent that you have authority to bind that organization.
ColorMe is a web and mobile application that uses artificial intelligence (powered by Google Gemini) to:
ColorMe is available at colorme.art and as a mobile application. We reserve the right to modify, suspend, or discontinue the service at any time with reasonable notice.
You must sign in with a Google or Apple account to use ColorMe. By signing in, you authorize us to receive your name, email address, and profile photo from your identity provider.
You are responsible for maintaining the security of your account and for all activity that occurs under your account. You must notify us immediately at hardy@402labs.app if you suspect any unauthorized use.
Age requirement: You must be at least 18 years old to create an account and subscribe. Users between 13 and 17 may use ColorMe only through an account held by their parent or legal guardian.
ColorMe requires a paid subscription to use. The current subscription fee is $4.99 per month. Pricing may change with 30 days' notice to existing subscribers.
Your subscription begins when you complete the checkout process. You will be charged $4.99 on the same calendar date each month. Subscriptions renew automatically unless cancelled before the renewal date. Billing is handled by Stripe, and by subscribing you agree to Stripe's terms of service.
You may cancel your subscription at any time through your account settings or by contacting us at hardy@402labs.app. Upon cancellation, your subscription will remain active until the end of the current billing period, after which access to premium features will end. We do not provide partial-month refunds except as required by applicable law or in cases of service failure on our part.
We may offer a free trial period from time to time. After the trial ends, you will be charged the subscription fee unless you cancel before the trial period expires.
You agree not to use ColorMe to:
We reserve the right to investigate and take appropriate action, including suspending or terminating accounts, for violations of this section.
You retain all rights to the photos and text prompts you provide as inputs. You also own the coloring pages generated from your inputs, subject to your compliance with these Terms and the terms of the underlying AI model providers. By using ColorMe, you grant us a limited license to store and display your generated images within the service solely to provide the service to you.
ColorMe, its design, software, branding, and all content we create are owned by 402labs and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of our service without our prior written consent.
ColorMe uses Google Gemini and other AI systems to generate coloring pages. AI outputs are inherently unpredictable, and we make no guarantees about the quality, accuracy, or suitability of any generated image for a particular purpose.
Generated images may occasionally be imperfect, unexpected, or not match your intent. The AI may decline to process certain content that it determines violates usage policies.
You are responsible for reviewing generated content before use. We are not liable for any harm arising from AI-generated outputs.
COLORME IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL 402LABS, ITS OWNERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF YOUR USE OF COLORME.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM OR (B) $10.00.
You agree to indemnify, defend, and hold harmless 402labs and its owners, employees, and agents from and against any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of your use of ColorMe, your violation of these Terms, or your violation of any rights of a third party.
We may suspend or terminate your account at any time if we believe you have violated these Terms, engaged in fraudulent activity, or for any other reason at our discretion, with or without notice. Upon termination, your right to use ColorMe ceases immediately.
You may terminate your account at any time by visiting our account deletion page or contacting us. Termination does not entitle you to a refund of any prepaid subscription fees except as required by law.
We may update these Terms from time to time. When we make material changes, we will notify you by email and update the “Last Updated” date. Your continued use of ColorMe after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using ColorMe.
These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or ColorMe shall be resolved in the state or federal courts located in Monmouth County, New Jersey, and you consent to personal jurisdiction in those courts.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm.
